BANKRUPTCY BUDDY USER AGREEMENT
Bankruptcy Buddy is your companion, resource, and organizational aid—not your attorney, accountant, financial advisor, or other professional advisor, and not a substitute for one. Filing for bankruptcy is an important and complex decision that should be made only with advice from qualified professionals who understand your individual circumstances.
Effective Date: October 22, 2026
This User Agreement (“Agreement”) governs your access to and use of the Bankruptcy Buddy website and its educational, organizational, document-analysis, and related tools (collectively, the “Service”). “Bankruptcy Buddy,” “we,” “us,” and “our” mean the operators of Bankruptcy Buddy. By accessing or using the Service, you agree to this Agreement and our Privacy Policy. If you do not agree, do not use the Service.
Article 1 — Your Privacy and Security
I. Consent to Disclosure and Processing. By accessing or using the Service and agreeing to this Agreement and the Privacy Policy, you consent to our disclosure of your personal information and User Content to third-party service providers that process information on our behalf as reasonably necessary to operate, maintain, secure, support, or improve the Service. These service providers may include providers of hosting, storage, security, analytics, customer support, artificial-intelligence processing, and document-processing services.
We may also disclose your information when reasonably necessary to:
A. comply with applicable law, legal process, or a valid governmental request;
B. investigate fraud, misuse, security incidents, or threats to the rights or safety of any person; or
C. complete a transaction or business transfer involving Bankruptcy Buddy, subject to applicable law.
We do not sell your personal information or disclose it to third parties for their independent advertising or marketing purposes.
II. Please redact sensitive information before uploading documents. We use reasonable safeguards to protect your information, but no website, artificial-intelligence system, storage system, or internet transmission is completely secure. Before uploading a document, you should redact information that the Service does not need, including:
A. Social Security and taxpayer-identification numbers;
B. bank, credit-card, and other financial-account numbers;
C. passwords, personal identification numbers, and security answers;
D. full birth dates;
E. driver’s-license, passport, and government-identification numbers; and
F. medical information and other sensitive personal identifiers.
III. Privacy Policy. Our Privacy Policy provides additional information about how we collect, use, retain, protect, and delete information. If this Agreement conflicts with the Privacy Policy concerning the handling of personal information, the Privacy Policy controls.
IV. No legal privilege. Uploading information to Bankruptcy Buddy does not create an attorney-client, accountant-client, or other professional relationship. Your communications with us and information stored through the Service are not protected by attorney-client privilege merely because you submitted them to the Service.
V. AI and Machine-Learning Processing. We may use third-party artificial-intelligence, machine-learning, hosting, storage, security, and document-processing service providers to operate and support the Service. By accessing or using the Service and agreeing to this Agreement and the Privacy Policy, you consent to our disclosure of User Content and personal information to those service providers for processing on our behalf.
We do not use User Content or personal information to train, fine-tune, or develop any third-party or general-purpose artificial-intelligence or machine-learning model. We use commercially reasonable efforts to select service providers whose privacy and security practices are generally consistent with ours, including providers whose stated practices indicate that they will use User Content only to provide the applicable services, will not add User Content to general training data, and will not make User Content available to other users.
We do not control our service providers and cannot guarantee their conduct, systems, confidentiality, security, data handling, retention practices, or compliance with their stated practices or with practices generally consistent with ours. To the fullest extent permitted by law, we are not responsible or liable for their acts or omissions, and you agree that Bankruptcy Buddy will not be liable for any loss, cost, or damage arising from them, subject to Articles 8, 10, and 11.
User Content is retained in identifiable form only as long as reasonably necessary to provide and secure the Service, after which it is deleted or deidentified in accordance with the Privacy Policy. The Service’s automated features are administrative and educational only; we do not use them to make automated decisions that produce legal or similarly significant effects about you, and we do not engage in profiling for those purposes. Where applicable privacy laws governing automated decision-making, profiling, or the training of machine-learning or artificial-intelligence systems apply to you, we will provide any additional notices, choices, or disclosures those laws require.

C. upload documents for automated review;
D. identify, extract, categorize, summarize, and display information found in uploaded documents; and
E. explore simplified estimates and examples based on information supplied by the user.
II. AI-assisted document analysis. The Service may use artificial intelligence and other automated technology to read uploaded documents, extract data, identify possible categories, create summaries, and organize information. These functions are administrative and educational only. They are not professional review or advice.
III. No filing-ready documents. The Service does not provide or prepare bankruptcy petitions, schedules, statements, plans, motions, or other documents intended to be filed with a court. No output from the Service is represented as complete, legally sufficient, or ready to file.

E. monitor court deadlines, notices, hearings, filing requirements, or case developments.
Article 3 — No Legal, Tax, Accounting, or Financial Advice
I. General information only. The Service provides general educational information and organizational assistance. Bankruptcy Buddy is not a law firm, accounting firm, financial-advisory firm, credit-counseling agency, or government agency.
II. No professional relationship. Use of the Service does not create an attorney-client, fiduciary, accountant-client, advisor-client, or other professional relationship with Bankruptcy Buddy or any person associated with it.
III. No recommendations or legal conclusions. The Service does not advise you:
A. whether, when, or where to file bankruptcy;
B. whether to file under a particular bankruptcy chapter;
C. how to characterize an asset, debt, income source, expense, transfer, exemption, claim, or creditor;
D. what information to include in or omit from a court filing;
E. how bankruptcy law applies to your particular circumstances; or
F. what result a court, trustee, creditor, or government agency may reach.
IV. No petition-preparation service. Bankruptcy Buddy does not prepare bankruptcy documents for filing, select answers for official forms, make filing decisions for you, or provide filing instructions tailored to your circumstances. You must not submit an output from the Service to a court or treat it as an official bankruptcy form.
V. Professional assistance. Before making decisions about bankruptcy, debt repayment, property, taxes, contracts, or court filings, consult qualified legal, tax, accounting, and financial professionals, as appropriate.
Article 4 — AI and Accuracy Limitations
I. AI makes mistakes. Artificial intelligence and automated tools may misread documents, overlook information, duplicate entries, assign information to the wrong category, use outdated information, make incorrect assumptions, or produce incomplete or inaccurate results.
II. You must verify everything. You are responsible for reviewing every result against the original documents and other reliable sources before relying on it. Do not assume that a result is accurate because it appears specific, personalized, confident, or complete.
III. Estimates are not outcomes. Calculators, comparisons, repayment examples, timelines, summaries, and other outputs are simplified educational estimates. They do not determine eligibility, legal rights, filing requirements, exemptions, dischargeability, plan confirmation, payment obligations, or likely case outcomes.
IV. Information may change. Bankruptcy rules, forms, procedures, dollar amounts, and local practices may change and may vary by location. We do not promise that information available through the Service is current, complete, or applicable to you.
Article 5 — Your Responsibilities
I. Accurate information. You are responsible for the accuracy, completeness, and lawfulness of all information and documents you submit and for correcting any errors in the Service’s outputs.
II. Your documents. You may upload only documents that you own or are legally permitted to use and process. You represent that your uploads and use of the Service do not violate another person’s privacy, confidentiality, intellectual-property, or other rights.
III. Original records. Keep your original documents and independent backups. The Service is not a permanent records-storage system, and we are not responsible for preserving your records.
IV. Deadlines. You are solely responsible for identifying and meeting all deadlines. Do not rely on the Service to calculate or remind you of any filing date, hearing date, payment date, response date, limitation period, or other deadline.
V. Account security. If the Service permits accounts, you must protect your login credentials, provide accurate account information, and promptly notify us at hello@bankruptcy-buddy.com if you suspect unauthorized access.
Article 6 — Eligibility and Acceptable Use
I. Eligibility. You must be at least 18 years old and legally capable of accepting this Agreement. The Service is intended for consumers in the United States exploring personal bankruptcy or related financial education.
II. Permitted use. You may use the Service only for lawful, personal, noncommercial educational and organizational purposes.
III. Prohibited use. You may not:
A. use the Service to provide legal services, prepare bankruptcy filings for another person, or operate a petition-preparation business;
B. submit false, fraudulent, unlawful, malicious, or infringing material;
C. upload malware or attempt to access another user’s account or information;
D. interfere with, overload, reverse engineer, scrape, copy, or bypass security features of the Service, except where applicable law expressly permits the activity;
E. use automated means to access the Service without our written permission; or
F. use the Service or its outputs to train, develop, or improve another automated or artificial-intelligence system.
Article 7 — Ownership and Permission to Process Uploads
I. Your content remains yours. As between you and Bankruptcy Buddy, you retain your ownership rights in documents and information you upload (“User Content”).
II. Limited permission. You give Bankruptcy Buddy a limited, nonexclusive permission to host, copy, process, analyze, organize, and display User Content solely as reasonably necessary to provide, secure, maintain, and improve the Service in accordance with this Agreement and the Privacy Policy.
III. Bankruptcy Buddy materials. The Service, including its software, design, text, educational content, graphics, organization, and branding, belongs to Bankruptcy Buddy or its licensors. Subject to this Agreement, we give you a limited, personal, revocable, nontransferable right to use the Service for its intended purpose.
IV. Feedback. If you voluntarily provide suggestions or feedback, we may use them without restriction or compensation, provided that we do not identify you publicly without your consent.
Article 8 — Third-Party Services and Resources
I. Third-Party Service Providers. The Service may rely on third-party providers for hosting, storage, security, analytics, customer support, artificial-intelligence processing, document processing, and other operational functions. By accessing or using the Service and agreeing to this Agreement and the Privacy Policy, you consent to our disclosure of your personal information and User Content to those service providers for processing on our behalf as reasonably necessary to provide and support the Service.
II. Service-Provider Practices and Liability. We use commercially reasonable efforts to select service providers whose privacy and security practices are generally consistent with ours. We do not control those providers and cannot guarantee their conduct, systems, confidentiality, security, data handling, retention practices, outputs, or compliance with their stated practices or with practices generally consistent with ours.
To the fullest extent permitted by law, Bankruptcy Buddy is not liable for, and you release Bankruptcy Buddy from, any loss, cost, or damage of any kind arising from the acts, omissions, errors, outages, security failures, data handling, retention practices, disclosures, or outputs of any third-party service provider, including providers of artificial-intelligence tools and models, hosting, storage, security, analytics, customer support, and document-processing services. Any reliance on a third-party provider or its outputs is at your own risk.
III. External resources. The Service may identify or provide access to information from courts, government agencies, professionals, nonprofit organizations, or other third parties. Bankruptcy Buddy does not control or endorse those parties and is not responsible for their content, availability, advice, services, or privacy practices.
IV. No professional endorsement. The identification of an attorney, accountant, counselor, financial professional, or other provider is informational only and is not a recommendation or guarantee.
Article 9 — Availability, Suspension, and Termination
I. Service availability. The Service is provided free of charge. We may add, change, suspend, or discontinue any feature at any time. We do not promise continuous access, permanent storage, or compatibility with any device or software.
II. Suspension or termination. We may restrict or terminate your access if you violate this Agreement, misuse the Service, create a security or legal risk, or if we discontinue the Service.
III. Your choice to stop using the Service. You may stop using the Service at any time. If account-deletion functionality is available, you may use it or contact us at hello@bankruptcy-buddy.com. Deletion and retention are governed by the Privacy Policy and may be subject to backup, security, fraud-prevention, and legal-retention requirements.
Article 10 — Disclaimers
I. As-is service. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.
II. No promised result. We do not warrant that the Service will be accurate, complete, current, secure, uninterrupted, error-free, or suitable for your circumstances. We do not guarantee any bankruptcy, financial, credit, tax, legal, or other outcome.
III. Your decisions. You remain responsible for your decisions, professional consultations, filings, communications, and actions. You use the Service and rely on its outputs at your own risk.
IV. Third-Party and AI Providers. The Service relies on third-party hosting, storage, security, analytics, customer-support, document-processing, artificial-intelligence, and other service providers and tools. We use commercially reasonable efforts to select providers whose privacy and security practices are generally consistent with ours. We do not control those providers and cannot guarantee their conduct, systems, confidentiality, security, availability, accuracy, outputs, data handling, retention practices, or compliance with their stated practices or with practices generally consistent with ours.
To the fullest extent permitted by law, we make no warranties of any kind, express, implied, or statutory, concerning any third-party service provider or tool. Third-party services and tools are provided “as is” and “as available,” and we are not responsible or liable for the acts or omissions of their providers.
Article 11 — Limitation of Liability
I. Excluded Losses. To the fullest extent permitted by law, Bankruptcy Buddy and its owners, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost data, income, savings, opportunities, or profits; missed deadlines; filing errors; creditor actions; decisions made using the Service; or any loss, error, interruption, delay, inaccuracy, disclosure, security failure, breach, or damage arising from or relating to a third-party service provider used in connection with the Service, including a provider of artificial-intelligence tools or other automated or document-processing technology.
Bankruptcy Buddy uses commercially reasonable efforts to select service providers whose privacy and security practices are generally consistent with ours, but we do not control them and cannot guarantee their conduct, systems, confidentiality, security, data handling, retention practices, outputs, or compliance. Accordingly, to the fullest extent permitted by law, you release Bankruptcy Buddy and its owners, officers, employees, contractors, affiliates, and licensors from damages to the extent they arise from the acts or omissions of those providers.
II. Liability cap. To the fullest extent permitted by law, the total liability of Bankruptcy Buddy and the persons listed above for all claims arising from or relating to the Service or this Agreement, including any claim arising from or relating to any third-party service provider or any provider of artificial-intelligence tools or other automated or document-processing technology, will not exceed $100.
III. Required exceptions. These limitations do not exclude liability that cannot lawfully be excluded or limited. Your rights may vary depending on the law that applies to you.
Article 12 — Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Bankruptcy Buddy and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Service, your violation of this Agreement, or User Content that infringes or violates another person’s rights. This obligation does not apply to the extent a claim results from Bankruptcy Buddy’s own unlawful conduct.
Article 13 — Changes to This Agreement
We may update this Agreement to reflect changes to the Service, our practices, or applicable requirements. We will post the revised Agreement and update its effective date. If a change materially affects your rights, we will provide reasonable notice through the Service or using the contact information associated with your account. Your continued use after the revised Agreement takes effect constitutes acceptance of the revised terms.
Article 14 — Governing Law and Disputes
I. Governing law. Federal law governs matters within federal jurisdiction. To the extent state law applies, this Agreement is governed by the laws of Delaware, without regard to its conflict-of-laws rules.
II. Forum. Any lawsuit arising from this Agreement or the Service must be brought in the state or federal courts located in the state of Delaware, unless applicable law requires another forum. You and Bankruptcy Buddy consent to the jurisdiction of those courts.
III. Informal resolution. Before filing a lawsuit, you and Bankruptcy Buddy agree to give the other written notice describing the dispute and requested relief and to allow 30 days for a good-faith effort to resolve it. This requirement does not prevent either party from seeking urgent injunctive relief or filing before a limitations period expires.
Article 15 — General Terms
I. Entire agreement. This Agreement and the Privacy Policy are the entire agreement between you and Bankruptcy Buddy concerning the Service and replace prior discussions or agreements concerning the same subject.
II. Severability. If any provision is held unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will remain effective.
III. No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
IV. Assignment. You may not transfer this Agreement without our written consent. We may transfer it in connection with a merger, reorganization, sale of assets, or transfer of the Service.
V. Electronic agreement. Your electronic acceptance has the same effect as a handwritten signature. You should save a copy of this Agreement for your records.
